Terms of Service

These Terms of Service (“Terms”) govern access to and use of Alchemy Makers (the “Service”), operated by Alchemy Makers (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Alchemy Makers is an AI video studio. You may upload media, spend prepaid credits, and receive generated video. Output quality is not guaranteed. Models, availability, credit costs, and features may change.

Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity on your account. We may suspend or terminate accounts that violate these Terms or create risk for other users or the Service.

Credits

Credits are prepaid digital goods used to run generations. They have no cash value, are not a stored-value account or money-transfer product, and are not redeemable except as described in our Refund Policy. Credits are deducted when a generation is submitted. Failed or canceled jobs are refunded to your credit balance, not as cash, unless we say otherwise.

Your content

You retain rights in media you upload. You grant us a limited license to store, process, and transmit that media solely to operate the Service, including sending it to infrastructure and model providers needed to complete a generation. You represent that you have all rights and consents required for the content you submit.

Subject to the rights of third-party models and your own inputs, we assign to you whatever rights we have in the generated output so you can use it for lawful purposes. We do not warrant that output is unique, accurate, or free of third-party claims.

Prohibited use

You may not use the Service to:

• Create or attempt to create child sexual abuse material, or any sexual content involving minors.
• Create non-consensual intimate imagery or deceptive deepfakes of real people without required rights and consent.
• Infringe intellectual property, privacy, or publicity rights.
• Commit fraud, impersonate others, or violate applicable law.
• Probe, disrupt, or overload the Service, or bypass credit, rate, or safety limits.
• Upload malware or attempt unauthorized access to any system.

Third-party processing

Generations are fulfilled by third-party model hosts (currently including Replicate) and related storage and payment processors. Their terms and privacy practices also apply to data they receive to complete a request. Payments are processed by Dodo Payments.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALCHEMY MAKERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR CREDITS IN THE THREE MONTHS BEFORE THE CLAIM.

Indemnity

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or end access if you breach these Terms or if we discontinue the Service. Unused credits have no cash value on termination except as required by law or our Refund Policy.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where your local consumer laws require otherwise. Courts located in Delaware will have exclusive jurisdiction, except that we may seek injunctive relief in any venue.

Changes

We may update these Terms. Continued use after an update constitutes acceptance of the revised Terms. Material changes will be posted on https://www.alchemymakers.com.
